Section 44 of the Australian Constitution states that you may not be a member of Parliament if you are found guilty of a serious crime or bankrupt. The cartoon may be funny in a sad way, but thank goodness it doesn't refer to democracies.
You know it's an interesting question. I was thinking about this today and I realized that most constitutions and formal states (as we know them) are borne out of war and bloodshed and revolution and the commission of horrific crimes. You mentioned on your blog the way the Ceausescus were dealth and the stain of that on the broader constitution. The same could be said of our English civil war and the bloodshed and wars for the supremacy of a given constitutional order. The same could be said of the post-Saddam Hussein Iraq etc. So, it's an interesting issue.
